These Terms and Conditions govern the use of the CyberByte Solutions website and the services offered by CyberByte Solutions. By using this website or requesting or purchasing our services, you acknowledge that you have read and understood these terms.
1. Website Information
The information provided on this website is for general informational purposes. Service availability, scope of work, pricing, estimated delivery times, and applicable conditions will be confirmed in writing before work begins.
CyberByte Solutions reserves the right to update website content, service descriptions, and pricing at any time. Changes to pricing will not affect an already confirmed service agreement unless otherwise agreed in writing.
2. Service Requests and Agreements
Submitting a contact form, sending an email, or requesting a quotation does not constitute a binding service agreement or guarantee that a particular service can be completed.
CyberByte Solutions may request additional information, conduct an initial assessment, or inspect a device or system before confirming the scope, price, and feasibility of a service.
A service agreement is established when the customer accepts the proposed scope of work and pricing. Any required advance payment must be received before work begins, unless otherwise agreed in writing.
Any additional work outside the agreed scope must be approved by the customer and may incur additional charges.
3. Payment Terms
3.1 Full Payment in Advance
Unless otherwise agreed in writing, 100% of the agreed service fee must be paid in full before CyberByte Solutions begins work or provides the requested service.
This requirement applies to services including, but not limited to:
- Data recovery.
- IT support and computer repair.
- Website development.
- Zoho CRM implementation and configuration.
- Business email setup.
- Technical consultations and other professional services.
For services involving physical devices, inspections, diagnostics, or recovery attempts, any applicable fees and payment requirements will be communicated to the customer before chargeable work begins.
Where a diagnostic fee is required, the customer must pay that fee before the diagnostic service begins, unless otherwise agreed in writing.
3.2 Payment Confirmation
A service will not be considered paid until the payment has been received and confirmed by CyberByte Solutions. CyberByte Solutions reserves the right to postpone the commencement of work until payment has been verified.
3.3 Quotations and Pricing
All quotations are based on the information available at the time they are issued. If an assessment reveals additional requirements, complications, or work outside the original scope, CyberByte Solutions will notify the customer of any revised pricing and obtain approval before proceeding with the additional work.
Unless otherwise specified, quotations are valid for the period stated in the quotation. If no validity period is stated, the quotation is subject to confirmation before acceptance.
3.4 Additional Work
Work requested outside the originally agreed scope may incur additional charges. CyberByte Solutions will communicate the additional costs and obtain the customer's approval before proceeding. Any additional payment must be received before the additional work begins, unless otherwise agreed in writing.
3.5 Payment Methods
Accepted payment methods will be communicated to the customer before payment is requested. Customers are responsible for ensuring that payments are made correctly and that any applicable transaction or transfer fees are covered where agreed.
3.6 Third-Party Costs
Services that require third-party subscriptions, software licences, hosting, domain registration, business email services, or other external products may involve additional costs.
Such costs will be communicated to the customer before a purchase or commitment is made on their behalf. Unless expressly included in the quotation, third-party fees are separate from CyberByte Solutions' service fees.
3.7 Outstanding Payments
Where a payment arrangement or deferred payment has been expressly agreed in writing, any outstanding amount must be paid by the agreed due date. To the extent permitted by applicable law, CyberByte Solutions may suspend further work or withhold outstanding deliverables while an agreed payment remains overdue.
4. Cancellations and Refunds
4.1 Cancellation Before Work Begins
If a customer cancels a service before work has started, any refund will be assessed in accordance with the agreed service terms and applicable law.
Any non-refundable third-party costs or other charges may be deducted only where lawful and previously disclosed or otherwise legally recoverable.
4.2 Cancellation After Work Begins
If a customer cancels after work has started, CyberByte Solutions may charge for work already performed and for non-refundable costs or commitments incurred, to the extent permitted by applicable law.
Any remaining prepaid balance will be assessed for refund in accordance with the agreed service terms and applicable law.
4.3 Completed Services and Digital Deliverables
Once a service has been completed or a deliverable has been supplied, refunds will not be provided solely because the customer changes their mind, subject to applicable statutory rights and any specific refund commitment made in writing.
Where a service has not been completed as agreed, CyberByte Solutions will assess the issue and seek an appropriate resolution in accordance with the service agreement and applicable law.
4.4 Data Recovery Refunds
Data recovery is a best-effort technical service, and successful recovery cannot be guaranteed. Any fees for assessments, diagnostics, recovery attempts, or other work must be explained to the customer before the relevant chargeable work begins.
If no data can be recovered, the applicable refund policy will depend on the agreed quotation and service terms. Diagnostic fees, attempted-work fees, and other charges already incurred are not automatically refundable, subject to applicable law and any written money-back guarantee.
4.5 Refund Processing
Where a refund is approved, it will generally be returned using the original payment method where reasonably possible. Processing times may depend on the payment provider or financial institution.
Nothing in these terms excludes a refund or remedy required by applicable law.
5. Data Recovery Services
Data recovery depends on the condition of the storage device, the nature of the failure, and other technical factors. CyberByte Solutions does not guarantee that any particular file, folder, or amount of data can be recovered unless an express written guarantee states otherwise.
Customers are advised to stop using a potentially failing storage device and seek professional assessment to reduce the risk of further damage.
The customer is responsible for:
- Confirming that they own the device or are authorized to request recovery.
- Informing CyberByte Solutions of known damage, previous recovery attempts, or other relevant issues.
- Providing suitable storage media for recovered files when required, unless otherwise agreed.
- Maintaining independent backups whenever possible.
- Ensuring that they have the legal right to access and recover the data concerned.
CyberByte Solutions will take reasonable care when handling customer devices and data. However, storage devices that are already failing or damaged may deteriorate further during examination or recovery attempts.
Any specific recovery procedure, risk, limitation, or additional fee identified during assessment will be communicated to the customer where reasonably practicable.
Customer data will be handled with reasonable care and accessed only to the extent reasonably necessary to perform the agreed service, subject to applicable law.
6. IT Support and Computer Repair
IT support and repair services may involve troubleshooting, system changes, software installation, configuration adjustments, hardware replacement, maintenance, or other technical procedures.
Although reasonable care will be taken, CyberByte Solutions cannot guarantee that every technical issue can be resolved or that a device or system will remain free from future faults.
Customers are responsible for maintaining backups of important data before repair, maintenance, or system modification unless backup services are expressly included in the agreed scope.
Hardware, software, operating systems, and other components may have existing faults or compatibility limitations that affect the outcome of a service. Customers must disclose any known damage, previous repair attempts, or other relevant technical issues before work begins.
Any replacement parts, warranties, manufacturer support, or third-party products will be subject to the applicable supplier or manufacturer's terms.
7. Uncollected Devices and Equipment
7.1 Collection Deadline
Customers must collect their devices, equipment, storage media, and other physical property within 30 calendar days of being notified that the service is complete or the item is ready for collection, unless another arrangement has been agreed in writing.
CyberByte Solutions will make reasonable efforts to notify customers when their devices or equipment are ready for collection. Customers are responsible for providing accurate contact information and arranging collection within the specified period.
7.2 Responsibility After 30 Days
If a device or item remains uncollected after the 30-calendar-day period, CyberByte Solutions will not be responsible for loss, theft, deterioration, or damage to the extent permitted by applicable law.
CyberByte Solutions cannot guarantee continued storage, preservation, or availability of uncollected items after this period.
This provision does not exclude responsibility for negligence, intentional misconduct, or other liability that cannot lawfully be excluded.
7.3 Storage Fees
Where permitted by applicable law, CyberByte Solutions reserves the right to charge reasonable storage fees after the initial 30-day collection period, provided the customer has been informed of the applicable fees in advance.
7.4 Unclaimed Property
The expiration of the 30-day collection period does not automatically transfer ownership of a device or item to CyberByte Solutions.
CyberByte Solutions will not sell, dispose of, recycle, or otherwise transfer ownership of an uncollected device solely because the collection period has expired, unless authorized by the customer or permitted by applicable law.
Any further action regarding unclaimed property will be taken in accordance with applicable legal requirements.
7.5 Collection Arrangements
Customers who anticipate being unable to collect their devices or equipment within 30 days should contact CyberByte Solutions before the collection deadline to request an extension.
Any extension must be confirmed by CyberByte Solutions in writing.
8. Website Development and Digital Services
Website development, business email configuration, Zoho CRM implementation, and similar services will be performed according to the scope of work agreed with the customer.
The customer is responsible for providing accurate content, instructions, branding materials, access permissions, and other information reasonably required to complete the project.
Unless expressly included in the quotation, the following may be charged separately:
- Domain registrations and renewals.
- Website hosting and infrastructure.
- Business email subscriptions.
- Software licences and third-party subscriptions.
- Integrations, and other paid components.
- Additional revisions, features, or functionality outside the agreed scope.
- Ongoing maintenance, technical support, and updates after project completion.
Delivery dates are estimates unless expressly confirmed as binding in writing. Delays caused by missing customer information, delayed approvals, third-party providers, or circumstances beyond reasonable control may affect delivery schedules.
Ownership, licensing, transfer of website files, administrative access, and other deliverables will be governed by the agreed project terms and applicable law.
Any outstanding payment obligations must be satisfied in accordance with the agreement before final delivery, except where otherwise agreed or required by law.
9. Customer Responsibilities
Customers agree to:
- Provide accurate and complete information relevant to the requested service.
- Confirm that they own, control, or have authorization to access any device, system, account, or data involved.
- Provide necessary approvals and access permissions.
- Maintain backups of important information unless backup services are expressly included.
- Avoid requesting unlawful activities or providing content they are not authorized to share.
- Pay all agreed fees in accordance with the applicable payment terms.
- Collect their devices and equipment within the applicable collection period.
Customers should not submit passwords, payment card details, or other sensitive authentication information through the website contact form.
10. Third-Party Services
Some services may depend on third-party platforms, software, hosting providers, domain registrars, email providers, payment processors, or other external services.
These providers operate under their own terms, fees, privacy policies, and service availability conditions.
CyberByte Solutions is not responsible for interruptions, price changes, policy changes, security incidents, or failures caused by third-party providers beyond its reasonable control. This does not exclude responsibility where CyberByte Solutions is legally liable for its own acts or omissions.
11. Limitation of Liability
CyberByte Solutions will exercise reasonable care and skill when providing services.
To the extent permitted by applicable law, CyberByte Solutions will not be liable for indirect or consequential losses, loss of anticipated profits, loss of business opportunities, or losses arising from circumstances beyond its reasonable control.
Customers remain responsible for maintaining appropriate backups and for decisions made using technical advice, reports, or other information supplied through a service.
Nothing in these terms excludes or limits liability for fraud, intentional misconductor any other liability that cannot legally be excluded or limited.
Nothing in these terms removes any consumer rights or remedies that cannot lawfully be waived.
12. Privacy and Customer Information
Information provided through the website or during service delivery will be handled for purposes reasonably related to responding to enquiries, providing services, processing payments, communicating with customers, and meeting applicable legal obligations.
Customers should avoid submitting unnecessary sensitive personal information through general contact forms.
Where customer devices, files, accounts, or systems must be accessed to perform a service, access will be limited to what is reasonably necessary for that service, subject to applicable law.
Any separate Privacy Policy published by CyberByte Solutions will also apply to the collection and handling of personal information.
13. Service Availability and Circumstances Beyond Our Control
CyberByte Solutions will make reasonable efforts to provide services within agreed timeframes.
However, delays or interruptions may occur because of power outages, internet disruptions, supplier issues, third-party service failures, natural events, government actions, or other circumstances beyond reasonable control.
Where such circumstances affect a confirmed service, CyberByte Solutions will communicate material delays where reasonably practicable and work with the customer to determine an appropriate next step.
14. Changes to These Terms
CyberByte Solutions may update these Terms and Conditions from time to time. The updated version will be published on this website with a revised effective date.
Changes will not automatically modify an existing service agreement where doing so would conflict with the agreed terms or applicable law.
Customers are encouraged to review these terms before requesting or purchasing services.
